04/19.06.2019 Heard the learned counsel for the parties.
The petitioner is an accused for the offence punishable under Sections 147/148/149/302 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the C.L.A. Act.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. The petitioner has not been named in the F.I.R. and his name surfaced on the alleged confessional statement of co-accused Bharat Manjhi who himself has been granted regular bail by a Bench of this Court vide order dated 05.05.2017 passed in B.A. No. 3438 of 2017. Other co-accused namely, Mana Singh, Barnabas Horo @ Barna Horo, Manish Singh and Samuel Aind have already been granted bail by different Benches of this Court. As such, the petitioner who is in judicial custody since 08.02.2019 may be given the privilege of regular bail.
The learned A.P.P. opposes the petitioner's prayer for bail. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Gumla in connection with S.T. No. 191 of 2018.
