The petitioner is an accused in a case registered under Sections 435, 427, 323 and 34 of the Indian Penal Code and Section 18 of the Criminal Law Amendment Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has committed no offence as alleged. It is further submitted that the petitioner has not been named in the first information report, however, he has been apprehended in connection with Ghaghra P.S. Case No.41 of 2018 registered under the Arms Act and, thereafter, on his alleged confessional statement he has been remanded in the present case. Except the alleged confessional statement of the petitioner and coaccused, the police has not collected any cogent evidence to connect his hand in the present case. The petitioner is in judicial custody since 2^nd January, 2019 and as such he may be given the privilege of regular bail.

Learned APP opposes the petitioner's prayer for bail.

Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner, above named, on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount, each, to the satisfaction of learned Sub Divisional Judicial

Magistrate, Gumla, in connection with Ghaghra P.S. Case No.54 of 2018, corresponding to G.R. No.452 of 2018, with a condition that the petitioner shall physically appear before the Trial Court on each and every date fixed till conclusion of the trial unless his physical appearance is exempted by specific order of the Trial Court for a particular date, failing which the said Court is at liberty to pass appropriate order against the petitioner in accordance with law.
