Shakil Ahmad Alias Sonu Khan Alias Sonu Ansari Vs the State of Jharkhand

Earlier on 26.6.2018 the prayer for bail of the petitioner was rejected on the ground that informant was an eye witness, who categorically stated that petitioner has fired upon her son on his legs and after he fell down, other person came and shot him. He renews his prayer on the ground that all the witnesses who have been examined in this case including the informant, have not supported the prosecution case. He submits that petitioner was not identified by the informant also. As per counsel for the petitioner informant has turned hostile.

Be that as it may, since trial is in progress and only three witnesses are remained to be examined in this case, I am not inclined to allow this application. Accordingly, the prayer for bail of the petitioner above named in connection with Garhwa Police Station Case No. 363 of 2017 (G.R. No. 1912 of 2017), corresponding to S.T. No. 279 of 2018, pending in the court of Additional Sessions Judge, VIth, Garhwa stands rejected.

Trial court is directed to take all possible steps so that trial can be concluded without giving unnecessary adjournment to the parties.
