Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with Madhupur P.S. Case No.146 of 2016 (G.R. No. 365 of 2016) for the offence registered under Sections 304B/34 of the Indian Penal Code.

Heard the parties.

Learned counsel appearing for the petitioners submits that the allegations against the petitioners are that the petitioners are responsible for causing dowry death of the deceased. By drawing the attention of the Court at page 17 to 22 of the brief which the certified copy of the final form, it is submitted that the police after due investigation did not send up the petitioners for trial due to lack of evidence and the learned S.D.J.M. without passing any speaking order just observed that there prima-facie offence committed under section 304B/34 of the Indian Penal Code. It is further submitted that the allegation against the petitioners are false and the petitioners are respectively the mother-in-law, father-in-law and brother inlaw (Devar) of the deceased. It is submitted that the husband of the deceased has already been granted bail by this Court vide order dated 30.01.2019 in A.B.A. No. 321 of 2019. It is next submitted that the cause of death of the deceased was that she accidentally slipped into the well. Hence, it is submitted that the petitioners be given the privileges of anticipatory bail.

The learned Addl. P.P. opposes the prayer for anticipatory bail.

Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that this is a fit case where the petitioners, named above, be given the privilege of anticipatory bail. Hence, in the event of their arrest or surrender within a period of four weeks from the date of this order, they shall be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Madhupur, in connection with Madhupur P.S. Case No.146 of 2016 (G.R. No. 365 of 2016) subject to the conditions laid down under section 438 (2) Cr. P.C.
