Apprehending his arrest in connection with G (F) Case No.222 of 2014 instituted under Sections 33 of the Indian Forest Act, the petitioner has moved this Court for grant of privileges of anticipatory bail.
The parties are absent in spite of repeated calls.
Perusal of the record reveals that the allegation against the petitioner is that the petitioner was excavating stones inside Maldiya forest after clearing the bushes and on seeing forest guards, he fled away. It has been mentioned in the petition of the anticipatory bail application that the petitioner is innocent and has been falsely implicated in this case. The petitioner is an old farmer and he has nothing to do with stone mining business and the petitioner has been falsely implicated in this case because of local village politics. It has been further averred in the petition that the informant was not known to the petitioner prior to the occurrence hence it is highly unlikely that the informant could know the name of the petitioner while he allegedly ran away from the place of occurrence.
Considering the aforesaid facts, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court of learned S.D.J.M, Hazaribagh within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on depositing Rs.2,000/-(Rupees two thousand) as cash security and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Hazaribagh in connection with G (F) Case No.222 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
