State.
The petitioner has been made accused for the offences under Sections 147, 148, 149, 353, 307 and 302 of the Indian Penal Code, Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act, Sections 4 / 5 of the Explosive Substance Act and Section 17 of the CLA Act, in connection with S.T. No. 90 of 2013, arising out of Chowka P.S. Case No. 15 of 2010 corresponding to G.R. No. 249 of 2010.
There was an encounter between the police party and the members of the extremists group, in which, one police constable was killed. The petitioner is named in the FIR, to be involved in the encounter. Earlier the bail applications of this petitioner were rejected on merits thrice.
Learned counsel for the petitioner has renewed the prayer for bail of the petitioner.
In the facts of this case, I am not inclined to enlarge the petitioner, Chand Mahto @ Sudama Mahto @ Sudam Mato @ Sudam Mahato @ Chand Mahato, on bail. Accordingly, his prayer for bail is rejected.
