Considering the submissions of the learned counsels and facts and circumstances of the case, this Court is of the considered opinion that this is a fit case where the above named appellants be given the privileges of anticipatory bail. Accordingly, the impugned order dated 08.01.2018 passed by the learned Additional Sessions Judge-I, Hazaribagh, in connection with SC/ST P.S. Case No.39 of 2017 corresponding to G.R. No.2684 of 2017, being not sustainable in law is set aside and the appellants named above, are directed to surrender before the court below within four weeks from the date of this order. In case of the appellants being arrested by police or surrendering in the court of learned Chief Judicial Magistrate, Hazaribagh within the stipulated time, they will be enlarged on bail on their depositing demand draft of Rs.2000/- each drawn in favour of the informant-respondent no.2-Rajindra Turi and on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with SC/ST P.S. Case No.39 of 2017 corresponding to G.R. No.2684 of 2017 with the condition that they will not disturb the possession of the informant over the place of occurrence-land and will not annoy or disturb him in any manner during the pendency of this case.
