Considering the submissions of the learned counsels and facts and circumstances of the case, this Court is of the considered opinion that this is fit case where the above named appellant be given the privileges of anticipatory bail. Accordingly, the impugned order dated 09.01.2018 passed by the learned Additional Sessions Judge-I, Jamshedpur, in connection with complaint case no.331 of 2017, being not sustainable in law is set aside and the appellant named above, is directed to surrender before the court below within four weeks from the date of this order. In case of the appellant being arrested by police or surrendering in the court of learned Judicial Magistrate, 1st Class, Jamshedpur within the stipulated time, he will be enlarged on bail on his depositing demand draft of Rs.5000/- drawn in favour of the informant-respondent no.2-Dulari Devi and on furnishing bail bond of Rs.10,000/(Rupees ten thousand), with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur in connection with complaint case no.331 of 2017 with the condition that he will not disturb the possession of the informant over the place of occurrence-land and will not annoy or disturb her in any manner during the pendency of this case.
