Under order dated 21.02.2018, a report was called for from the court of 8th Addl. Sessions Judge, Hazaribagh or his successor court as well as from the court of SDJM, Hazaribagh or his successor court as to whether the petitioner is dead or alive.
Perused the report submitted by Sri Surendra Sharma, Distt. & Addl. Sessions Judge-IX-cum- F.T.C. for Rape cases, I/C Court of Addl. Sessions Judge-VII, Hazaribagh, which reveals that petitioner-Doe Shankar Singh is alive.
Similar report has also been received from the A.S.I. Ramgarh Police Station.
It appears that this revision application is admitted for hearing on 13.03.2003 and the petitioner was admitted on bail and the lower court record was called for. It was listed before this Bench for the first time on 16.01.2018 and after some adjournments, it is listed today.
Today when the case is called out, no body appears on behalf of the petitioner. Learned Addl. P.P. is present. It appears that petitioner has lost its interest in this case.
Accordingly, this revision application is dismissed for non appearance.
