08/05.10.2018 Instant application has been filed for initiating contempt proceeding against the opposite parties for noncompliance of order and direction of this Court dated 30.10.2017, passed in W.P.(S) No. 5903 of 2017.

Mr. Sameer Sahay, AC to learned AG appearing on behalf of opposite parties very fairly submits that order of this Court has already been complied and petitioner has already received benefits of 1^st ACP on 13.07.2018 and for payment of remaining benefits against 2^nd and 3^rd MACP, recommendation has already been made by the respondents and statement to that effect has been made in paragraphs-6 and 8 of the show-cause dated 25.08.2018, filed by the opposite party no. 2. Learned counsel submits that in view of the development, this contempt proceeding may be dropped.

In view of specific averments of learned counsel appearing on behalf of opposite parties, this Court is of the view that order of this Court has been complied with and as such, this contempt proceeding is dropped.
