The petitioner is apprehending his arrest in connection with Dhanwar P.S. Case No. 177/2017 corresponding to G.R. No. 1632/2017, the case registered under Sections 21(A)21(b)/22 of the Indian Penal Code and section 4/54 of the JMMC rules and section 3/92) of Mines Sales Rules, 2004.

Heard learned counsel for the parties.

It appears that petitioner no.1- is the the proprietor of SAI Stone Works and petitioner no.2 is the lease holder for mining in plot no. 284/part , Area

1.12 Acres of Mauza Parodih.

Learned counsel for the petitioners are innocent and they have been implicated in this case on the basis of suspicion. Hence, they deserve bail

Learned A.P.P opposed the prayer for bail.

¶16

Considering the fact and circumstances of the case, the above named petitioners are directed to surrender in the Court below within Four Weeks from today and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners, on bail, on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of JM, Giridih in connection with Dhanwar P.S. Case No. 177/2017 corresponding to G.R. No. 1632/2017 , subject to the conditions as laid down under Section 438(2) of the Cr.P.C., subject to the condition that one of the bailers must be local resident of Giridih and subject to the further conditions as follows :

Petitioners shall deposit Rs.15,000/- each in the court below on or before their date of surrender, thereafter their bail bonds will be accepted, which shall be subject to the final result of the case.

Petitioners shall also give an undertaking by filing an affidavit through their pairavikar that they will co-operate in the investigation.

Petitioners are directed to deposit their Cell Number and the Xerox copy of Aadhar Card in the court below, and if I.O. wants to record the statement of the petitioners, he will file application in the court below through APP for release of the Cell Number and Xerox copy of Aadhar Card of the petitioners and after getting the same, he will give 72 hours' notice to the petitioners fixing date, time and place and, thereafter, petitioners will appear

before him and get their statement be recorded.

If petitioners fail to do so, it will be open for the I.O. to file an application before this court through the Addl.P.P. for cancellation of bail bonds of the petitioners.

Let a copy of this order be communicated to the court below through FAX and also handed over to learned APP for transmission of the same to the I.O of this case.
