Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with the case registered under Sections 175, 379, 414 of the Indian Penal Code, Section 21A of the Mines and Minerals (Regulation and Development) Act.
Learned counsel for the petitioner has submitted that is innocent and falsely been implicated in this case.
Learned A.P.P has opposed the prayer for bail.
In the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge V-cumJudicial Magistrate, Giridih in connection with Dhanwar (Parsan) P.S. Case No. 242 of 2017 corresponding to G.R. No. 2145 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, subject to the further condition that on the date of surrender petitioner shall deposit Rs. 6,000/- in the trial Court. The aforesaid deposition will be subject to the result of the case.
