The petitioners are apprehending their arrest in connection with Ichak P.S. Case No. 156 of 2017, corresponding to G.R. No. 2568 of 2017 for the offence under sections 272/273 of the Indian Penal Code and under section 47 (A) of the Excise Act.

Learned counsel for the petitioners has submitted that petitioners have been falsely implicated in this case. No case under the alleged sections is made out agaisnt the petitioner. Further, it has been submitted that the petitioner was not in possession of the alleged premises at the relevant point of time nor the seized articles belonged to the petitioner.

Learned A.P.P opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, the above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)each, with two sureties of the like amount each to the satisfaction of the court of Sri Darshana, learned J.M, Ist Class, Hazaribag in connection with Ichak P.S. Case No. 156 of 2017, corresponding to G.R. No. 2568 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
