Petitioner is apprehending his arrest in connection with Borio (J) P.S. Case No. 51 of 2014, corresponding to G.R. No. 116 of 2014 for the offence under sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code and under section 27 of the Arms Act.

The learned Sr. counsel for the petitioner has submitted that police after investigation submitted charge-sheet concluding the involvement of four accused persons except the present petitioner and accordingly cognizance was taken and the case of the charge-sheet accused persons was committed to the court of Sessions. Thereafter, a protest petition under section 193 Cr.P.C was filed on behalf of the informant and on the basis of which cognizance was taken. Further, it has been submitted that in connivance with village people and police, the petitioner has been implicated in the present case by the informant and his brother with an ulterior motive.

Learned A.P.P as well as learned counsel for the O.P. No. 2 opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, the petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named

petitioner on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Sahibganj in connection with Borio (J) P.S. Case No. 51 of 2014, corresponding to G.R. No. 116 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
