Petitioners are apprehending their arrest in connection with the case registered under Sections 379, 411 of the IPC and Sections 8(3) JTTR, 4 and 21 MMDR and 6 JMDR Rule.

It appears that under order dated 06.08.2018, the concerned I.O was directed to verify annexure 4 and 4/1, which is report of the Project Officer, which reveals that the petitioner has already paid IGST and to submit its report along with the up-to-date case diary to this Court.

The required report along with the up-to-date case diary has been received which reveals that GST tha rate of GST is same in both the cases inter state and intra state. However, if IGST has been paid then coal can be transported in other State.

Under the facts and circumstances of the case, I am inclined to admit the above named petitioners on anticipatory bail. The petitioners are directed to surrender in the court below within four weeks and in the event of their arrest or surrender, the court below shall release them on bail on their furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Pakur, in connection with Pakur (M) P.S. Case No.86/17, corresponding to G.R.No.589/2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
