Petitioners are apprehending their arrest in connection with the case registered under Sections 448, 341, 323, 354(A), 379, 504, 34 of the IPC.

It appears that under order dated 08.08.2018, learned counsel for the petitioner was directed to ensure the appearance of Laxmi Devi in Title Suit No.111/2017, pending in the court of civil Judge, Senior Division-1, Jamshedpur and further, civil Judge, Senior Division-1, Jamshedpur was directed to submit a repot as to whether principal Defendants nos. 1 to 5 have appeared or not and also indicating the status of proforma defendants nos. 6 to 9 whether they have appeared or not.

The required report has been received, which reveals that out of nine defendants, defendants no.1 to 5 are prinicipal defendant whereas defendants no.6 to 9 are proforma defendant. Principal defendants Nos. 1 to 4 and proforma defendant no.6 and 8 have appeared in the suit. Proforma defendant no.8 State Bank of India, Sakchi Branch has filed written statement on 16.03.2018. Principal defendant nos. 5, 7 and 9 fail to appear in this case and finally suit is being proceeded exparte against defendant nos. 5, 7 and 9 vide order dated 13.07.2018 and 01.10.2018 respectively. The principal defendant nos. 1 to 4 and proforma defendant no. 6 have been debarred from filling written statement and the suit is being proceeded under Order VIII rule 10 of C.P.C.

Under the facts and circumstances of the case, I am inclined to admit the above named petitioners on

anticipatory bail. The petitioners are directed to surrender in the court below within four weeks and in the event of their arrest or surrender, the court below shall release them on bail on their furnishing bail bond of Rs.15,000/- (Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Jamshedpur, in connection with Sakchi P.S. Case No.200/17, corresponding to G.R.No.3031/2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
