Petitioner is apprehending her arrest in connection with Jamua P.S. Case No. 260 of 2016, corresponding to G.R. No. 3030 of 2016, registered under Sections 147, 380, 504, 506 of the I.P.C., lodged on the basis of one written report given by Sonia Devi.

It is submitted by learned counsel for the petitioner that the instant case is counter version of Jamua P.S. Case No. 259/2016 registered under Sections 147, 149, 341, 342, 504, 506, 354 (B) and 379 of the I.P.C. lodged by petitioner.

It appears that under order dated 20.11.2017, learned APP was directed to produce the case diary and to file counter affidavit and interim relief of no coercive was granted in favour of the petitioner and the matter was directed to be listed after filing of the counter affidavit.

It appears that counter affidavit has been filed by learned APP on 29.08.2018, but the matter was not listed and only on the basis of Bench Slip which was filed on 08.10.2018, the matter is listed today.

Be that as it may, I am inclined to admit the petitioner on anticipatory bail. The above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of her arrest or surrender, the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1^st Class, Giridih, in connection with Jamua P.S. Case No. 260 of 2016, corresponding to G.R. No. 3030 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Further, Joint Registrar (Judicial) is directed to hold an inquiry as to why, inspite of categorical direction passed in

order dated 20.11.2017 to list the case after filing of the counter affidavit, the matter was not listed before this Court as per the direction and to submit a report to this court within eight weeks.

List this case after eight weeks.

Let a copy of order be sent to the court below and also communicated to the Joint Registrar (Judicial) for submission of report.
