Petitioner is apprehending his arrest in connection with Rajpur P.S. Case No. 64 of 2017, corresponding to G.R. No. 1164 of 2017 for the offence under section 295A/34 of the Indian Penal Code and under section 12 of Jharkhand Bovine Animal Prohibition Slaughter Act.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. Noting has been recovered from the possession of the petitioner. The petitioner has no criminal antecedent.
Learned A.P.P opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the Court of learned A.C.J.M, Chatra, in connection with Rajpur P.S. Case No. 64 of 2017, corresponding to G.R. No. 1164 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C .
