Counsel for the parties submits that the parties have amicably settled the dispute before the Mediator, JHALSA, Ranchi. Report of the Mediator, JHALSA, Ranchi suggests that the parties have settled the dispute and the terms and conditions are already on record. The opposite party no.2 has no objection, if the provisional bail granted to the petitioner vide order dated 21.08.2018 is confirmed, but the opposite party prays that the petitioner be directed to comply the terms and conditions of the Mediation.
Considering the fact that the parties have settled the dispute, I am inclined to confirm the provisional bail granted to the petitioner vide order dated 21.08.2018. Accordingly, this application is allowed and the provisional bail granted to the petitioner vide order dated 21.08.2018 in connection with Sector-XII Police Station Case No. 43 of 2017 (G.R. No. 836 of 2017), pending in the Court of the learned Judicial Magistrate 1st Class, Bokaro, is hereby confirmed.
It is expected that the petitioner will comply the terms and conditions as formulated with consent of the parties before the Mediator, JHALSA, Ranchi, failing which the opposite party no.2 will be at liberty to approach before the appropriate Court.
