Habib Ansari Alias Kutubulla Vs the State of Jharkhand

Petitioner is an accused for allegedly committing the offence punishable under Sections 419, 420 of the Indian Penal Code, Sections 66(B), 66(C), 66(D) of the Information Technology Act, in connection with Margomunda Police Station Case No.109 of 2017 corresponding to G.R. No.1181 of 2017, pending in the Court of learned Judicial Magistrate 1^st Class, Madhupur.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. All the transactions are genuine transactions and no money was transferred fraudulently from any third party accounts. There is no criminal antecedent of the petitioner.

During course of arguments, it transpired that out of 10 chargesheet witnesses, 8 witnesses have already been examined.

Considering the progress of the trial, since only two witnesses remain to be examined, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner, namely, Habib Ansari @ Kutubulla, in connection with Margomunda Police Station Case No.109 of 2017 corresponding to G.R. No.1181 of 2017, pending in the Court of learned Judicial Magistrate 1^st Class, Madhupur, is hereby rejected.

Trial Court is directed to take all steps so as to conclude the trial at the earliest.

This application stands dismissed.
