It is submitted that in the morning, the petitioner has committed the murder of the deceased and remained with the body. The informant came in the afternoon at the place of occurrence, where the dead body of the deceased was lying and the petitioner was found there. He never fled. He submits that the petitioner is mentally unstable. Counsel for the petitioner submits that the deceased being the wife of this petitioner had not given medicine to the petitioner, who was suffering from mental deceases, resulting in altercation and the occurrence took place.

After hearing the parties and from perusal of medical report, it appears that the petitioner was suffering from mental decease and his condition improved after administering medicine as prescribed by the Doctor.

In view of the aforesaid fact, I am inclined to release him on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Principal District and Session Judge, Seraikella, in connection with Adityapur P.S. Case No. 38/2018, corresponding to G.R. No. 160 of 2018 .
