4/11.10.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.
The petitioner is an accused for allegedly committing offence punishable under Sections 147, 148, 149, 452, 323, 324, 325, 307, 379, 354, 504 & 506 of the Indian Penal Code and Section 27 of the Arms Act.
From the FIR and the impugned order, I find that the allegation against this petitioner is general and omnibus in nature. There is allegation that this petitioner and others, by forming unlawful assembly, entered the house of the informant and assaulted the informant and his family members and taken away jewelry and other valuable items. There is specific allegation against Vikash Singh, Anil Singh, Amit Singh and Shiv Prakash Singh.
In view of the fact that there is general and omnibus allegation against this petitioner, I am inclined to enlarge him on bail. Accordingly, petitioner namely, Bhima Shankar Ojha @ Golu @ Bhim Shankar Ojha is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss Tabinda Khan, Judicial Magistrate, 1st Class, Dhanbad in connection with Jorapokhar P.S. Case No. 73 of 2018.
