Heard the counsel for the parties.
Learned A.P.P opposes the prayer for bail.
The petitioner is an accused for the offence punishable under Section
366A of the Indian Penal Code.
It is alleged that the daughter of the informant, aged about 13 years, was kidnapped by the son of the petitioner. The victim girl was recovered and her statement was recorded under Section 164 Cr.P.C in which, she stated that the son of the petitioner kidnapped her.
Taking into consideration the statement of the victim girl, recorded under Section 164 Cr.P.C., I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Deoghar in connection with Sonaraithari P.S. Case No. 59/2017, corresponding to G.R. No. 2158/2017.
