Heard the counsel for the parties.
The petitioner is an accused for the offence punishable under Section 364, 34 and 379 of the Indian Penal Code, Section 27 of the Arms Act and later on Sections 302, 201 and 120B IPC have been added.
It is alleged that the name of this petitioner has come in this case on the basis of confessional statement of one of the accused persons, namely, Dhaneshwar Mahto, who was involved in commission of the murder of the deceased. It is alleged that the dead body of the deceased, his mobile phone and motorcycle were recovered from the confessional statement of co-accused, Dhaneshwar Mahto.
Learned A.P.P opposes the prayer for bail but he has not controverted the aforesaid submission.
In view of the aforesaid fact, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Session Judge-I, Ramgarh in connection with Mandu (Kuju) P.S. Case No. 381/2014, corresponding to G.R. No. 4212/2014 (S.T. No. 63/2017).
