Heard the counsel for the parties.
The petitioner is an accused for the offence punishable under Sections 364 and 302 r/w Section 34 of the Indian Penal Code and Section 17 of the CLA Act.
The deceased was taken from his house and later on her dead body was recovered.
Counsel for the petitioner submits that the name of the petitioner has not been taken by the inmates of the house of the deceased. He further submits that one accused- Anup Ekka was arrested and he has taken the name of this petitioner. Counsel for the petitioner further submits that there is no eye witness to the occurrence.
Learned A.P.P opposes the prayer for bail but has not controverted
the aforesaid submission.
In view of the aforesaid facts, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Session Judge-VI, Gumla in connection with Dumri P.S. Case No. 24/2011, corresponding to G.R. No. 958/2011 (S.T. No. 250 of 2014).
