Petitioners are apprehending their arrest in connection with Barharwa P.S. Case No. 95 of 2018, corresponding to G.R. No. 401 of 2018 for the offence under sections 341, 324, 307, 379, 34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case. There is delay of 23 hours in lodging the F.I.R. Further it has been submitted that present case is counter blast of Barharwa P.S. Case No. 102 of 2018, G.R. No. 413/2018.
Learned A.P.P opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, the above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand)each with two sureties of the like amount each to the satisfaction of the court of Shri R.K. Pandey, learned J.M, Ist Class, Rajmahal, in connection with Barharwa P.S. Case No. 95 of 2018, corresponding to G.R. No. 401 of 2018 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The petitioners are directed to deposit Rs, 7,000/- each before the court below on the date of their surrender. Thereafter trial court will issue notice to the informant and after appearance of informant aforesaid amount will be released in favour of informant after making proper verification. The aforesaid deposition of amount will
not affect the case of petitioners during trial.
