Pursuant to the order dated 25/9/2018 the Director General of Police, Jharkhand Ranchi is personally present today in Court. He submits that he will look into the matter as to why the prime witness, i.e the victim has not been made a charge-sheet witness in this case. He further submits that he will see that this type of mistake be not repeated in future by the Investigating Officer and the Supervising officials. He undertakes to pass necessary orders to this effect.

Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.

The petitioner is an accused for allegedly committing an offence punishable under Sections 364/34 of the IPC.

Case of the petitioner was earlier rejected. This is a case of kidnapping of minor boy for ransom. Petitioner is not named in the FIR. Petitioner is in custody since 2.2.2013 i.e more than five and half years. Similarly situated co-accused person has already been granted bail by the co-ordinate bench of this Court in B.A. No. 6399 of 2018.

Taking into consideration the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-III, Hazaribagh in connection with Sadar Police Station Case No. 75 of 2013 (G.R. No. 369 of 2013), corresponding to S.T. No. 304 of 2013, subject to the condition that petitioner shall appear before the trial court on each and every date during trial, failing which his bail bond shall stand cancelled and trial court shall take appropriate steps for his re-arrest.
