Petitioner is apprehending his arrest in connection with Sadar P.S. Case No. 135 of 2017, corresponding to G.R. No. 471 of 2017, registered under Sections 323, 341, 504, 506, 467, 419, 468, 471, 120B / 34 of the I.P.C.
Pursuant to order dated 04.07.2018, both the parties are along with their learned counsels are physically present.
Possibility of reconciliation of the dispute through the process of mediation is explored, but the stand of the parties are at variance.
In this case, case diary has been received. From perusal of para-57 of the case diary, it appears that after investigation, the Dy.S.P. has opined that there is lack of evidence against the petitioner and directed to submit final form.
Learned APP has opposed the prayer for anticipatory bail.
Be that as it may, I am inclined to admit the petitioner on anticipatory bail. The above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Hazaribagh, in connection with Sadar P.S. Case No. 135 of 2017, corresponding to G.R. No. 471 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
