Petitioner is apprehending his arrest in connection with Radhanagar P.S. Case No. 40 of 2017, corresponding to G.R. No. 379 of 2017 for the offence under sections 414, 419, 420, 467, 468, 471 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that petitioner is innocent and he has committed no offence as alleged in the F.I.R and the name of the petitioner has been disclosed in the present case on the basis of statement of coaccused Md. Hasan except that nothing has come against the petitioner during entire investigation.
Learned A.P.P opposed the prayer for anticipatory bail.
Case diary has been produced. Para 50 of the case diary reveals that original registered owner of the truck bearing Registration No. BR06GB-9123 is Chandan Kr. Singh and the said vehicle which was brought to Motihari to Radhanagar and kept in garage and registration number was changed, para 47 of the case diary reveals that the seized truck bearing Reg. No. BR06GB-9123 current registration JH18E-2511 has been released in favour of original owner by the Court of learned S.D.J.M, Rajmahal on a petition filed by the owner. Further, it appears that investigation is still going on.
