Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.

The petitioner is an accused for allegedly committing an offence punishable under Sections 147, 148, 149, 452, 302 IPC and Section 27 of the Arms Act and Section 17 CLA Act in connection with Kamdara Police Station Case No. 41 of 2017 (G.R. No. 871 of 2017), pending in the Court of learned Judicial Magistrate, 1^st Class, Gumla.

Petitioner is not named in the FIR. Two persons name has transpired in the FIR i.e Yakub Kerketta and Dullu Munda. FIR clearly suggests that said these two persons have committed murder of the deceased.

Counsel for the petitioner submits that it is apparent in the FIR that aforesaid two accused persons have committed murder of the deceased and petitioner is not named in the FIR. He lastly submits that similarly situated co-accused persons have already been granted bail by this Court in B.A. No. 9981 of 2017.

Taking into consideration the aforesaid facts, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Gumla in connection with Kamdara Police Station Case No. 41 of 2017 (G.R. No. 871 of 2017), subject to the condition that petitioner shall appear before the trial court on each and every date during trial, failing which his bail bond shall stand cancelled and trial court shall take all possible steps for his apprehension.
