The petitioner is an accused for allegedly committing offence punishable under Sections 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code, Section 66(A)(B)(D) of I.T. Act.

Learned counsel for the petitioner submits that the petitioner has been implicated solely on the basis of the confessional statement of Ajay Kumar Mandal. He submits that there is no recovery from the possession of this petitioner. He submits that save and except confessional statement of the co-accused there is nothing to implicate or to connect him with the aforementioned case. He further submits that from criminal antecedent report send by the concerned officer, it is apparent that save and except this particular case there is no other case pending against the petitioner. Lastly he submits that the petitioner is in custody since 20.11.2017.

No one appears on behalf of the State to oppose the prayer

for bail.

Keeping in view of the aforesaid submission, I am inclined to allow this application. Accordingly, the petitioner, namely, Lalu Mandal @ Churaman Mandal is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of C.J.M, Giridih, in connection with Tara Tand, P.S. Case No. 69 of 2014, corresponding to G. R. No. 3939 of 2014.
