Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.
The petitioners are accused for allegedly committing an offence punishable under Sections 342/307/302/34 IPC in connection with Sarath Police Station Case No. 122 of 2016 (G.R. No.662 of 2016) corresponding to Sessions Trial No. 37 of 2017, pending in the Court of learned Additional Sessions Judge-VI, Deoghar.
FIR is the dying declaration of the deceased. Dying declaration clearly suggests that these petitioners have sprinkled kerosene oil and burnt her. When the deceased was breast feeding her infant child, these petitioners sprinkled kerosene oil on her and her child and burnt them to death. This is a very heinous offence where the infant who was being breast fed was killed by burning.
In view of the nature of allegation, I am not inclined to grant privilege of bail to the petitioners. Accordingly, the prayer of bail of the petitioners above named in connection with Sarath Police Station Case No. 122 of 2016 (G.R. No.662 of 2016) corresponding to Sessions Trial No. 37 of 2017, pending in the Court of learned Additional Sessions Judge-VI, Deoghar stands rejected.
