4/12.04.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.
The petitioner is an accused for allegedly committing offence punishable under Sections 395 & 397 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is not named in the FIR. It is submitted that exactly similarly situated co-accused persons namely, Birendar Tiwari @ Biru Tiwari, Sita Ram Tiwari, Vikram Dhobi and Narayan Kumar @ Narayan Singh have already been granted bail by Coordinate Benches of this Court in B.A. Nos. 3590/2015, 3105/2016, 4117/2017 and 6301/2017 respectively.
Learned A.P.P. opposes the prayer for bail but cannot deny the aforesaid fact that similarly situated has been granted bail.
Taking into consideration the aforesaid fact, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner namely, Vikash Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of Miss Pooja Kumar, Judicial Magistrate, 1st Class, Koderma in connection with Chandwara P.S. Case No. 96 of 2014 [G.R. No. 960/2014].
