The petitioner is an accused for the offence punishable under sections 313, 323,354,307,379,452,498(A) of the Indian Penal Code and under section 3/ 4 of the Dowry Prohibition Act.

The petitioner is the husband.

This case arises out of the complaint, which has been sent under the provisions of section 156(3) Cr.P.C. for registration of the F.I.R. and investigation. There is allegation of torture and demand of dowry. There is also allegation of termination of pregnancy.

Counsel for the petitioner submits that the petitioner has remained in custody for more than 7 months and he is ready to keep his wife.

Counsel appearing on behalf of the opposite party no.2 opposes the prayer for bail and submits that the opposite party no.2-wife was tortured for demand of dowry by this petitioner and his family members. She also submits that the minor son of the petitioner has also been driven out from his house and at present he is residing with his mother-opposite party no.2.

Taking into consideration the submissions of the parties and the fact that the petitioner has remained in custody for more than 7 months, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Chandan Kumar Sharma @ Tinku is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Ramgarh, in connection with Mandu (Kujju) P.S. Case No. 287 of 2016, corresponding to G.R. No. 1047 of 2016, subject to condition that the petitioner will appear before the trial Court on each and every date fixed in the case during the trial, failing which the bail bond of the petitioner shall stand cancelled and the trial court shall take all possible steps for his re-arrest.
