Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner.
Petitioner is an accused for allegedly committing the offence punishable under Section 302 of the Indian Penal Code, in connection with Chandawa Police Station Case No.100 of 2017 (G.R. No.545 of 2017) corresponding to Session Trial No.192 of 2017, pending in the Court of learned Additional Sessions Judge I, Latehar.
Learned counsel for the petitioner submits that this cannot be a case which will fall within the purview of Section 302 of the Indian Penal Code. He submits that under the influence of liquor, petitioner had assaulted the deceased. Deceased returned and next day he died. He submits that there is no eye witness to the occurrence.
Taking into consideration the submissions made by the learned counsel for the petitioner, abovenamed petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge I, Latehar in connection with Chandawa Police Station Case No.100 of 2017 (G.R. No.545 of 2017) corresponding to Session Trial No.192 of 2017.
