The petitioners are accused for the offences punishable under sections 419,420,468,470,471,120B of the Indian Penal Code and under sections 66(B),66(C),66(D) and 84D of the Information Technology Act.

It is alleged that the petitioners are involved in cyber crime. The allegation is that by making calls to different persons, the petitioners got the money transferred fraudulently in their account and thereafter withdrew the same.

Learned Sr. Counsel appearing for the petitioners submits that in the entire case diary there is nothing to suggest that the money was transferred in the account of the petitioners. He further submits that only material has come against the petitioners that they were talking with other persons.

Addl. P.P. opposes the prayer for bail, but cannot controvert the aforesaid statement.

Taking into consideration the aforesaid facts and the fact that the petitioners have got no criminal antecedent, I am inclined to release the petitioners on bail. Accordingly, the petitioners, namely, Pappu Kumar Yadav (in B.A. No. 194 of 2018) and Anuj Kumar Mandal (in B.A. No. 216 of 2018) are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Deoghar, in connection with Mohanpur P.S. Case No. 317 of 2017, corresponding to G.R. No. 1842 of 2017.
