The petitioner is apprehending his arrest in connection with Godda (Mahila) P.S. Case No. 15/2017 corresponding to G.R. No. 1147/2017, the case registered under Sections 498A of the Indian Penal Code and section ¾ of the D.P.Act.
Pursuant to order dated 24.07.2018, both the parties are physically present before this court and the possibility of reconciliation between then is explored.
It appears that the stand of the parties is at variance.
From perusal of Annexur-A to the supplementary affidavit filed on behalf of the petitioner, it appears that O.P.No.2 has solemnized second marriage on 08.05.2017 with one Mukesh Kumar Sah under the Special Marriage Act, althought O.P.No.2 has denied the same.
Be that as it may, the above named petitioner is directed to surrender in the Court below within Four Weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of CJM, Godda, in connection with Godda (Mahila) P.S. Case No. 15/2017 corresponding to G.R. No. 1147/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Let a copy of this order be communicated to the trial court.
