The petitioner apprehends his arrest in connection with C/1 Case No.

1384 of 2017.

Submission has been advanced by the learned counsel for the petitioner that petitioner is the husband of the complainant and the allegations are general and omnibus in nature. It has been submitted that petitioner has already filed a suit for dissolution of marriage and after receiving the notice, the complaint petition has been instituted.

Learned counsel for O.P. No. 2 has submitted that petitioner has continuously tortured the O.P. No. 2 for long and in fact allegations levelled in the complaint petition do suggest that it is the petitioner, who is the main accused.

The complaint petition reveals general allegations levelled against all the accused persons including the petitioner. It further appears that divorce suit had been filed by the petitioner prior to institution of the complaint petition. It also appears that as a retaliation to the divorce suit filed by the petitioner, complaint petition has been filed.

On consideration of the aforesaid fact, this application is allowed.

Petitioner, named above, is directed to surrender in the court below within a period of three weeks from today and pray for regular bail, and in that event, he will be enlarged on bail, on furnishing bail bond of Rs.10,000/- ( Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st class, Jamshedpur, in connection with C/1 Case No. 1384 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
