Despite valid service of notice, O.P. No. 2 has failed to appear.
Petitioners are apprehending their arrest in connection with Kotwali P.S. Case No. 194 of 2017, corresponding to G.R. No. 3779 of 2017 for the offence under sections 504, 341, 323, 325, 354, 354A (i), 324, 307, 289, 506, 34 of the Indian Penal Code.
The learned counsel for the petitioners has submitted that the present case is nothing but counterblast of Kotwali P.S. Case No. 186 of 2017 lodged by the petitioner no. 2 against the informant on 11.07.2017 under sections 458, 504, 323, 379 of the Indian Penal Code. Further, it has been submitted that in fact the petitioner no. 1 was on duty on 15.07.2017 ie. Date of occurrence, he was not present at the place of occurrence. Further, it has been submitted that only to take rival action against these petitioners, the present F.I.R has been lodged by the informant.
Learned A.P.P opposed the prayer for anticipatory bail and produced case dairy diary.
From perusal of case diary it appears that that wife of informant has received injury which is simple in nature.
In the facts and circumstances of the case, the petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the
event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Ranchi in connection with Kotwali P.S. Case No. 194 of 2017, corresponding to G.R. No. 3779 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
