Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner.
Petitioner is an accused for allegedly committing the offence punishable under Sections 364A/120B of the Indian Penal Code, in connection with Panki Police Station Case No.10 of 2018 (G.R. No.185 of 2018) corresponding to Sessions Trial No.319 of 2018, pending in the Court of learned Additional Sessions Judge-II-cum-Vacation Judge, Palamau at Daltonganj.
It is alleged that one Ram Dayal Oraon was kidnapped. Later on he was released.
Learned counsel for the petitioner submits that one of the similarly situated co-accused has been granted bail by this Court in B.A. No.6727 of 2018. He submits that while granting bail to Sandeo Oraon, it has been observed that the kidnapped person has not taken the name of any of the miscreants. Learned counsel for the petitioner further submits that the petitioner was also not put on Test Identification Parade.
Considering the aforesaid facts, petitioner, namely, Sandeep Kumar Bhuiyan @ Sandip Bhuiyan, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Vacation Judge, Palamau at Daltonganj, in connection with Panki Police Station Case No.10 of 2018 (G.R. No.185 of 2018) corresponding to Sessions Trial No.319 of 2018.
