From the allegation made in the complaint petition, it appears that both the sides are descendants of common ancestor-Khikhri Pandey and the family members of both the parties have lived separately since long, but on 27.10.1997, the brother of the complainant had filed a complaint case in the court of learned CJM, Deoghar against the petitioners under Sections 147 and 379 of the Indian Penal Code. On coming to know about the institution of the said case, the petitioners became agitated and on the date of occurrence, when the complainant was going to Deoghar along with P.W.1 to purchase some clothes and other materials on the eve of Deepawali and as soon as he reached near the place of occurrence, the petitioners held the complainant and assaulted him with fist, causing injuries on the left eye brow, mouth and body. It is alleged that accused No.1 snatched Rs.920/- from the possession of the complainant and the accused No.2 snatched his Titan Wrist Watch valued at Rs.15,00/-. It is alleged that after the occurrence, the complainant went to Deoghar Hospital where he was given medical treatment and since the police refused to register the case, the complaint case was instituted as PCR Case No.376 of 1997.
