02/ 13.09.2017 Heard the learned counsels appearing for the parties and perused the documents on record.
The petitioner has been made an accused in Giridih (M) P.S. Case No.200 of 2017 registered for the offence punishable under sections 457/380 IPC.
Mr. R.S. Mazumdar, the learned Senior counsel for the petitioner submits that the prosecution case against the petitioner, at best, is that he purchased the stolen ornaments from co-accused- Md. Hasib @ Sarfaraj. The petitioner is in judicial custody since 21.06.2017 and charge-sheet has been submitted in this case.
Opposing the prayer for grant of bail, Mr. Deepak Kumar, the learned APP submits that stolen ornaments were recovered from the house of the petitioner.
Having regard to the fact that the petitioner is said to be purchaser of "the alleged stolen ornaments" and having regard to the facts and circumstances of the case, the petitioner, Ashish Thakur @ Ashish Kumar, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two

sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Giridih in connection with Giridih (M) P.S. Case No.200/2017 corresponding to G.R. No.1668/2017, on the following conditions:
(i) he shall appear before the trial court, regularly, and
(ii) he shall not change his place of residence without prior permission of the court.
The instant application is allowed. Let a copy of the order be transmitted to the trial Court through 'FAX'.
