4/ 13.09.2017 Heard the learned counsels appearing for the parties and perused the documents on record.

The petitioner has been made accused in Sadar (Bara Bazar) P.S.Case No.370/2016 corresponding to G.R.Case No.1125/2016 registered under sections 147,148, 149, 295, 295-A IPC.

Referring to order granting bail to co-accused-Vicky Khan in B.A.No.4626 of 2017 by a co-ordinate Bench of this Court, the learned counsel for the petitioner submits that the petitioner who was also implicated in Sadar P.S.Case No.366/2016 and granted bail in the said case, deserves bail in this case also. Moreover, he is in judicial custody since 22.03.2017.

The learned APP has opposed the prayer for grant of bail.

Having regard to the facts and circumstances of the case, the petitioner, namely, Md. Mujammil @ Md. Mojammil Ansari, is directed to be released on bail, if not wanted in any other case, on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each; one of the bailors shall be class-I legal heir/sharer of the petitioner, to the satisfaction of learned C.J.M., Hazaribag in connection with Sadar (Bara Bazar) P.S.Case No.370/2016 corresponding to G.R.Case No.1125/2016, on the following conditions:

(i) he shall appear in both the cases on each and every date during the trial, but for special circumstances for which he shall move an appropriate application before

the trial court for exemption from appearance,

(ii)he shall not change his place of residence without permission of the court, and

¶16

(iii) he shall report to the office of the Superintendent of Police, Hazaribag on every Sunday between 9 a.m to 10 a.m and a report in this regard from the office of the Superintendent of Police, Hazaribag shall be transmitted to the trial court, every month.

In breach of any of the conditions, prosecution shall file an appropriate application for cancellation of bail in this Court.

This application is allowed. Let a copy of this order be sent to the trial court through FAX.
