The petitioner has been made an accused in Mirzachouki P.S. Case No.74 of 2016, registered for offence punishable under Sections 302/34 IPC.

In a First Information Report which was lodged against unknown when name of the petitioner was disclosed by co-accused persons, the petitioner has been taken into judicial custody on 21.01.2017. Other co-accused persons, on whose confessional statement, petitioner's name has transpired have been granted bail vide, B.A. No.3260 of 2017.

Mrs. Vandana Bharti, the learned A.P.P. has opposed the prayer for grant of bail, however, she is unable to distinguish the case of the petitioner from other co-accused persons who have already been granted bail.

Having regard to the facts and circumstances of the case,

the petitioner namely, Dinesh Kisku, is directed to be released on

bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Sahibganj in connection with Mirzachouki P.S. Case No.74 of 2016, corresponding to G.R. No.537 of 2016 (S.T. No. 123 of 2017), on the condition that he shall appear before the trial court, regularly, and he shall not change his place of residence without prior permission of the court.

The instant application is allowed. Let a copy of the order be transmitted to the trial Court through 'FAX'.
