04/01.09.2017 Heard the learned counsels appearing for the parties and perused the documents on record.
Petitioner has been made an accused in Barkatha P.S. Case No. 103 of 2017 which was registered for the offence under Sections 273/290 I.P.C and Section 47(A) Excise Act.
On an information that huge quantity of liquor/foreign liquor was transported in a vechicle, TATA 407 was apprehended in which Royal Stag, Imperium Blue etc. were found loaded. The petitioner was the driver of the said vehicle. He is in judicial custody since 01.06.2017.
Mr. Rajneesh Vardhan, the learned APP has opposed the prayer for grant of bail.
Having regard to the facts and circumstances of the case, the petitioner namely, Jasim Ansari @ Jasim is directed to be released on bail on furnishing bail bond of Rs.10,000/(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Hazaribagh in connection with Barkatha P.S. Case No.103 of 2017, corresponding to G.R. No.1545 of 2017.
The instant application is allowed. Let a copy of the order be transmitted to the trial Court through 'Fax'.
