02 / 14.06.17 Apprehending his arrest, the sole petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Gomia P.S. Case No. 141 of 2014 registered under Sections 413, 414, 379, 411, 120 (B) of the Indian Penal Code, 4 (i) Coal Mines Act and 33 of the Indian Forest Act.

Heard learned counsel appearing for the petitioner as well as learned Addl. PP for the State.

The learned counsel appearing for the petitioner submits that he is the owner of the truck no. JH02N-1932, which was seized while transporting thirty tons of coal. The petitioner has got nothing to do with the coal which was transported. It was further submitted that the co-accused has already been granted bail by this court vide ABA No. 117 of 2017. Hence, this petitioner also deserves to be released on bail.

The learned Addl. PP opposes the prayer for bail.

Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant privileges of anticipatory bail to the sole petitioner. Hence, in the event of his arrest by the police or surrender within a period of four weeks from the date of this order, he shall be released on bail on depositing Rs. 4,000/- as cash security and furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned JM, 1^st class, Bermo at Tenughat in connection with Gomia P.S. Case No. 141 of 2014 (G. R. No. 1262 of 2014 ) subject to the conditions laid down under section 438 (2) Cr. P.C.
