04 /14.06.2017 Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with C.P. Case No. 3062 of 2015, registered under sections 498(A) and 323 of the Indian Penal Code.
Heard the learned counsel for the petitioner and the learned Addl. P.P. for the State.
The learned counsel for the petitioners submits that the petitioner is the brother in law (Dewar) of the informant and there is general and omnibus allegation against the petitioner. After a compromise has been effected between the parties, the mother in law and father in law of the informant have already been given the privilege of anticipatory bail vide A.B.P. No. 2348 of 2016 by the learned court below. Hence, the petitioners be also given the privilege of anticipatory bail.
The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the facts as discussed above, I am of the opinion that it is a fit case where the petitioner Akbar Ali @ Akbar Ali Sadar be admitted to anticipatory bail. Hence, in the event of his arrest or surrender within a period of four weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate – 1st Class, Dhanbad or her successor court, in connection with C.P. Case No. 3062 of 2015 subject to the conditions laid down under section 438 (2) Cr. P.C.
