02 /13.06.2017 Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with Devipur P.S. Case No.31 of 2017 (G.R. No. 350 of 2017) registered under sections 147, 148, 149, 323, 379, 307, 427 and 504 of the Indian Penal Code.

Heard learned counsel appearing for the petitioners as well as learned Addl. P.P. for the State.

The learned counsel for the petitioners submits that there is a counter case regarding the same occurrence and the co-accused person whose case stand on the same footing has been given the privilege of anticipatory bail by this Court vide order dated 13.04.2017 in A.B.A. No. 1981/2017 and on the principle of parity, the petitioners be also given the privilege of anticipatory bail.

The learned Addl. P.P. opposes the prayer for bail but concedes that the allegations against the petitioner are the same as against the accused person, who has been given the privilege of anticipatory bail by this court.

Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant privileges of anticipatory bail to the petitioners. Hence, in the event of their arrest or surrender within a period of four weeks from the date of this order, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Deoghar, in connection Devipur P.S. Case No.31 of 2017 (G.R. No. 350 of 2017) and depositing Rs. 3000/- each as ad interim victim compensation to be paid to the to the victims Subhan Ansari, Rafiq Ansari and Safik

Ansari, subject to the conditions laid down under section 438 (2) Cr. P.C. In case, the petitioners deposit the ad interim compensation amount in the court of learned Judicial Magistrate, Deoghar, the court is directed to issue notice to the said three victims and release the said amount in their favour in equal proportion, after proper verification.
