The petitioner is apprehending his arrest in connection with Basia P.S. Case No. 10/2017 corresponding to G.R. No. 154/2017, the case registered under Sections 414/34 of the Indian Penal Code and Section 12(i)(ii) of Jharkhand Bovine Animal (Prohibition of Slaughter) Act and section 11 of Cruelty to Animal Act,1960.
Learned counsel for the petitioner submitted that petitioner has been falsely implicated in this case because he is the owner of the truck bearing registration no. UP-64A-8021. It is further submitted that he had no knowledge about the said transaction of animals nor he has been arrested at the spot.
Learned A.P.P opposed the prayer for bail.
Considering the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Gumla, in connection with Basia P.S. Case No. 10/2017 corresponding to G.R. No. 154/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., subject to the further condition that on the date of surrender petitioner shall deposit Rs.8,000/- in the court below.
The aforesaid deposit shall be subject to the final result of the case.
