04/ 16.11.2017 Counsel for the petitioner undertakes to remove the surviving defect no. 6 during course of the day.

Petitioner seeks suitable extension of time for preferring the appeal before the Appellate Forum in terms of order dated 21.03.2017 passed in WPC No. 1207/2017. Learned counsel explains that despite diligent steps taken by the petitioner, learned counsel conducting the case at Bokaro, unfortunately died on 15.04.2017 and the appeal could not be filed. When the petitioner came to know of the death, then he has approached the present counsel for seeking suitable extension of time for preferring the appeal by filing this modification petition.

Having considered the submissions of the learned counsel for the parties and the grounds urged, time to prefer the appeal before the Appellate Authority in terms of order dated 21.03.2017 is extended by two weeks. The Appellate Authority thereafter would consider the question of delay on its merits in preferring the appeal. Instant petition stands disposed of.
